General Overview
This website aims to present and sell the artworks of Noémi Holbrecht (“Seller”) to users of the site (hereinafter the “Users” and potential “Buyers”), allowing them to discover and purchase artworks directly from the Seller.
The artworks include original paintings, limited edition prints and custom works.
These General Terms and Conditions of Sale and Use define the terms and conditions of online sales of the artworks presented on the website, establish the rights and obligations of the parties, and outline the conditions of use of the site.
Full and unconditional acceptance of these terms is required to complete a sale. Acceptance is confirmed by checking a box in the order form.
1. Use of the Website
The information and services offered are provided “as is.” The Artist reserves the right to modify, suspend, or remove any part of the website without prior notice.
We reserve the right to deny access or services in accordance with Article 8 below.
2. Products
This site offers original artworks and limited edition prints. Each product listing includes:

Please note that product colors may slightly vary due to lighting conditions during photography and differences in screen displays. The Artist is committed to representing the artworks as accurately as possible.
3. Prices
Prices are listed in euros, VAT included. Shipping fees are specified before order confirmation. For orders outside the EU, the Buyer is responsible for any customs duties and local taxes. Prices may change without notice.
We reserve the right to cancel any order in the event of a clear pricing error (typo, incorrect listing on the site, etc.), even after confirmation.
4. Orders
Placing an order implies acceptance of these terms and conditions. A confirmation email is sent to the Buyer upon validation.

5. Payment and Shipping
Payment can be made by Visa, MasterCard, Bancontact, PayPal, or bank transfer.
Artworks are shipped within 15 business days after payment has been received, unless due to force majeure or temporary travel abroad by the Artist, in which case a longer delay may apply. The Buyer will be informed by email as soon as possible in such cases.
Ownership of the artwork remains with the Artist until full payment is received. The risk of loss or damage during shipping is transferred to the Buyer once the artwork is handed over to the carrier. In case of issues, the Artist will assist the Buyer in handling claims.
6. Right of Withdrawal
If you wish to withdraw from the sale and return an item to the Artist, you have 14 days from the receipt of your order to exercise your right of withdrawal.
Within this timeframe, you must send an email to studio@noemiholbrecht.com and return the item to the Artist’s address listed above.
Return shipping costs are the responsibility of the Buyer.
If the artwork is not returned within this period, the Artist reserves the right to refuse a refund.
Custom artworks are not eligible for withdrawal. They are created at the Buyer’s own risk and may not be returned.
7. Claims and Returns
Please check the condition of your order upon delivery. If you notice visible damage or an apparent issue of conformity, it is recommended that you contact us within 48 hours to help facilitate a resolution.
In such cases, the purchase price and return shipping costs will be refunded upon presentation of supporting documentation.
For returns under the right of withdrawal (without defect), return costs remain the responsibility of the Buyer.
8. User Responsibilities
8.1 Access and use of the website are free. Some features may require account creation or personal data. Without this information, access to certain features may be restricted.
8.2 Users agree to use the website responsibly and must not compromise its security, accessibility, or functionality. Uploading viruses, attempting to hack, or any malicious activity is strictly prohibited.
8.3 The website and its content are intended for private and personal use only. Any commercial use, direct or indirect, without written permission from the Artist is prohibited.
8.4 By accessing the website, you confirm that you are of legal age in your country of residence, or that you have parental or guardian permission if you are a minor.
8.5 You agree not to use the website or the services/products offered for any unlawful, fraudulent, or unauthorized purposes, and to comply with all applicable laws, including those relating to intellectual property.
Violating these terms may result in the immediate suspension or termination of your access to the website and its services.
9. Intellectual Property
All artworks, designs, texts, images, and content on this website are the exclusive property of the Artist and are protected by copyright and intellectual property laws.
You agree not to reproduce, copy, sell, resell, distribute, or exploit any part of the artwork, website, or its content without prior written authorization from the Artist.
Any unauthorized use, whether commercial or otherwise, is strictly prohibited and may result in legal action.

14. Force Majeure
The Artist cannot be held liable for delays caused by unforeseen events beyond her control. If a product is not delivered within 30 days of payment, both parties agree to negotiate in good faith to determine appropriate actions.
15. Modifications and Errors
We may modify or correct any information on the site without prior notice. In case of an error in price or product description, the order may be canceled.
16. Applicable Law and Jurisdiction
These terms are governed by Belgian law. Any dispute will be submitted to the courts of Brussels.
